Resolution Fixing Zoning Application and Building Permit Fees

Resolution Fixing Zoning Application and Building Permit FeesWHEREAS, The County Board of Bureau County is authorized by statute and by the Bureau County Zoning Ordinance to fix zoning fees for applications for rezoning, for conditional uses, for variances and for appeals, and further to fix fees for applications for building permits; and

WHEREAS, it has become necessary to modify the terminology used in the fee schedule for clarification purposes from time to time;

NOW, THEREFORE, BE RESOLVED by the County of Bureau, a body politic and corporate, acting by and through its County Board in regular meeting assembled, as follows:

  1. 1.0The following fee schedule is in effect for petitions or applications to rezone, for conditional uses, for variances, and for appeals:
  2. 1.1Applications made prior to construction of a foundation, erection of any structure, or change of use of property:
    • Regularly scheduled hearing:
      • Petition to Rezone$225.00
      • Petition for Conditional Use$225.00
      • Petition for Variance$125.00
      • Petition for Appeal$125.00
    • Special Hearing:
      • Petition to Rezone$700.00
      • Petition for Conditional Use$700.00
      • Petition for Variance$350.00
      • Petition for Appeal$350.00
  3. 1.2Applications made after construction of a foundation, erection of any structure, or change of use of property:
    • Regularly scheduled hearing:
      • Petition to Rezone$725.00
      • Petition for Conditional Use$725.00
      • Petition for Variance$625.00
      • Petition for Appeal$625.00
    • Special Hearing:
      • Petition to Rezone$1200.00
      • Petition for Conditional Use$1200.00
      • Petition for Variance$750.00
      • Petition for Appeal$750.00
  4. 1.3In all circumstances, if the hearing on any petition herein listed, is continued to a special hearing, the Petitioner shall pay for and/or reimburse the County for all expenses incurred by the County on their behalf, related to said special hearing, which are in excess of the application filing fee paid by the Petitioner.
  5. 1.35Applicant shall also be responsible for the actual cost of the public hearing, which includes the cost of the transcript and reporting time of court reporter, cost of a Natural Resource Information Report from the Bureau County Soil and Water Conservation District and cost of publication of the legal notice in the local newspaper. Applicant shall also be responsible for consultation under the Illinois Endangered Species Protection Act and Illinois Natural Areas Preservation Act and for applicable fee(s). Applicant shall be responsible for obtaining all State and Federal permits, reports and studies and other consultations as required by State and Federal law. Applicant shall pay all applicable fees as required by State and Federal law.
  6. 1.4Applications for building permits; mobile home permits; commercial towers; small wind energy systems:
    • Mobile Home Permit$100.00
    • Building Permit Fee$30.00 for first $5000.00 and $3.00 for each additional $1,000 of cost of construction, which is defined as the cost of materials and labor.
    • Cellular communications towers, wind energy towers and all commercial towers$25.00 per foot height.
    Tower height for wind energy towers shall be measured from the ground to the tip of the rotor blade when the blade is at its highest. or 12 o'clock, position.

    Co-locations of additional equipment (i,e., installation of additional equipment) on an existing facility or replacement of existing equipment on an existing facility shall be a flat fee of $1,200.00. Commercial tower fees shall apply per tower.
    • Small Wind Energy Permit$250.00 per small wind energy tower.
  7. 1.5If an application is filed pursuant to Sec. 1.4 above and permit is issued prior to any excavation, construction of a foundation or erection of any structure is made, then the building permit fee is as stated above.
  8. 1.6If an application is filed pursuant to See. 1.4 above and permit is issued after any excavation, construction of a foundation or erection of any structure is made, then the building permit fee is double the amount stated above.
  9. 1.7Applicant shall also be responsible for consultation under the Illinois Endangered Species Protection Act and Illinois Natural Areas Preservation Act and for applicable fee(s). In areas not served by public water and sewer, applicant shall also be responsible for the cost of a Zoning Evaluation or a septic and well permit issued by the Bureau County Health Department. Applicant shall be responsible for obtaining all State and Federal permits, reports and studies and other consultations as required by State and Federal law.
  10. 1.8Application fee for Preliminary Plat$225.00
    Application fee for Final Plat$225.00 + 10.00 per lot

    In addition to the fees set forth above, applicant shall reimburse the County for reproducing plats and for all engineering expenses of checking plats, water, sewer and other plans, and for inspection of construction of the facilities required by this Ordinance. Applicant shall also be responsible for consultation under the Illinois Endangered Species Protection Act and Illinois Natural Areas Preservation Act and for applicable fee(s). Applicant shall be responsible for obtaining all State and Federal permits, reports and studies and other consultations as required by State and Federal law. Applicant shall pay all applicable fees as required by State and Federal law.
  11. 2.0This resolution shall become effective upon passage, hereby replacing the previous resolution of March 12,2013.
